Municipal elections in UP: HC repeals OBC reservation, Will it dent BJP’s vote-bank?

The Lucknow bench of the Allahabad High Court on Tuesday gave an important decision regarding the upcoming municipal elections in Uttar Pradesh. The High Court has given its decision to elect and conduct municipal corporations without OBC reservation. The court said that until there is no triple test, there will be no OBC reservation, the Election Commission can conduct elections without OBC reservation.

The Lucknow bench of the Allahabad High Court on Tuesday pronounced its 70-page verdict. In its decision, the High Court canceled the OBC reservation issued by the government. All the seats reserved for OBCs will now be treated as general. The High Court has directed to get the replacement done immediately. That is, now the way has been cleared for the election of Municipal Corporations in UP and issuance of notification.

It is noteworthy that the High Court has rejected the draft notification issued by the government on December 5, 2022 and the mandate issued in this regard on December 12, 2022. It is obvious that now the ball is in the government’s court and that is why everyone’s eyes are on its next step. Experts believe that conducting elections without OBC reservation is going to be not only difficult but very difficult for the government. In such a situation, after this decision, there is a churning session is going on of BJP in the presence of state president Bhupendra Chaudhary at the Lucknow headquarters, on the other hand, a meeting of the government is going to be held on this in the evening. It is being said that the decision of the court is being studied by the Department of Justice. It is believed that the Yogi government may go to the Supreme Court against this decision. Soon a commission will also be formed for OBC reservation.

In fact, OBC reservation has become such an issue for the Yogi government on which the opposition is constantly attacking the government. After the decision of the High Court, the opposition has started accusing the government of conspiring to end the OBC reservation. SP leaders say that the government deliberately left some such lacuna due to which the talk of elections without OBC reservation has come up. In such a situation, experts say that the issue of municipal elections without OBC reservation can affect the OBC vote bank of BJP. That’s why BJP would never want such a situation to come. So, BJP will find some way or the other to give a positive message to OBCs but it will take some time. However, it is not legally possible to postpone the municipal elections after the decision of the High Court, until the government receives a new order from the Supreme Court. Therefore, according to experts, there is every possibility that the government will soon approach the Supreme Court.
